1. Purpose

These Terms of Service govern the use of the Sellect.lu platform, a service connecting property sellers with real estate agencies in Luxembourg.

2. Definitions

  • Platform: the Sellect.lu website and its associated services
  • Seller: any natural or legal person wishing to sell real estate property
  • Agency: any professional real estate agency registered on the Platform
  • Lead: a seller's contact details transmitted to a selected agency
  • User: any visitor or member of the Platform

3. Registration and account

3.1 For sellers

Registration is free. The seller agrees to provide accurate and up-to-date information about their property and contact details. The seller confirms being the owner or authorized representative of the property offered.

3.2 For agencies

The agency must be a duly registered company in Luxembourg with the necessary authorizations to operate as a real estate agent. Registration is subject to verification by our team.

4. How the service works

4.1 Listing submission

The seller submits a listing describing their property. The listing is visible to verified agencies without the seller's personal contact details being shared.

4.2 Expression of interest

Agencies can express interest in a property. The seller is notified and can view the profiles of interested agencies.

4.3 Selection and payment

The seller selects the agencies of their choice. Selected agencies are then invited to proceed with payment to access the seller's contact details.

5. Pricing

The service is free for sellers. Agencies pay a fixed amount for each lead acquired. Rates vary according to the type of mandate chosen by the seller and the agency's subscription.

Current rates are displayed on the Platform and may be modified at any time, with changes applying to new transactions.

6. User obligations

6.1 General obligations

  • Provide accurate and up-to-date information
  • Not use the Platform for illegal purposes
  • Respect the rights of other users
  • Not circumvent payment mechanisms

6.2 Specific obligations for sellers

  • Be the owner or authorized representative of the property
  • Provide an honest description of the property
  • Respond to inquiries from selected agencies

6.3 Specific obligations for agencies

  • Maintain a valid operating license
  • Contact sellers professionally
  • Not resell or share sellers' contact details

7. Liability

Sellect.lu acts as an intermediary and does not participate in negotiations between sellers and agencies. We do not guarantee the completion of a sale. Each party remains responsible for their own commitments.

We endeavor to verify the information provided, but cannot guarantee its accuracy. In case of dispute between users, Sellect.lu is not a party to it.

8. Refunds

Payments made by agencies are generally non-refundable. However, a refund may be granted in the following cases:

  • Clearly erroneous or non-existent contact details
  • Property already sold at the time of payment
  • Proven fraud

Refund requests must be sent to support@sellect.lu within 7 days of payment.

9. Intellectual property

All elements of the Platform (logos, texts, design, features) are the exclusive property of LUXEE Tech OÜ and are protected by intellectual property law.

10. Termination

Each user may terminate their account at any time. Sellect.lu reserves the right to suspend or terminate any account in case of non-compliance with these Terms of Service.

11. Modification of Terms

We may modify these Terms at any time. Modifications take effect upon publication. Continued use of the Platform constitutes acceptance of the new terms.

12. Applicable law and jurisdiction

These Terms are governed by Luxembourg law. Any dispute shall be subject to the exclusive jurisdiction of the courts of Luxembourg.
